Terms and Conditions

The Fair Path Project
Last updated: September 28, 2026

These terms govern your access to and use of hrcourse.fairpathproject.com and any course, download, template, or related material offered through it (the "Courses"). The site is operated by Fair Path Labs, Inc., doing business as The Fair Path Project ("Fair Path," "we," "us").

By enrolling in a Course or using this site, you agree to these terms. If you do not agree, please do not enroll.

1. Not Legal Advice
This is the most important term in this document.

Fair Path is not a law firm, and we do not provide legal advice. Our Courses, templates, sample letters, policy language, and downloads are educational materials. They are also not medical or mental health advice. They describe general frameworks and common practices and are not tailored to your situation, your employer, or the law in your jurisdiction.

Nothing in a Course creates an attorney-client relationship. No template we provide is a substitute for review by a licensed employment attorney in your state, and we recommend that review before you submit, send, or file anything based on our materials.

Employment law varies by state and changes over time, and time limits may apply to legal claims. You are responsible for confirming what applies to you.

2. No Guarantee of Outcome
Our Courses teach documentation, analysis, and communication frameworks. They do not guarantee any particular result. We make no promise that following our materials will resolve a workplace situation, prevent retaliation, produce a settlement, succeed in litigation, preserve your employment, or advance your career. Testimonials on our site describe individual experiences and are not representative of typical results.

3. Enrollment and Accounts
You must be at least 18 years old to enroll. You agree to provide accurate information and to keep your login credentials confidential. You are responsible for activity that occurs under your account. Course access is granted to you personally and may not be shared, resold, or transferred.

4. Payment
Prices are listed at the point of purchase and are in U.S. dollars. Your payment method is charged when you enroll.

5. Refunds
You may request a full refund within 14 days of purchase, as long as you have completed no more than 30 percent of the course. After 14 days, or once you have completed more than that, purchases are non-refundable.

If you asked us to report continuing education credit to HRCI, SHRM, or another body, the purchase is non-refundable once the credit has been reported.

If a technical problem on our side prevents you from accessing a course and we cannot fix it, you may request a full refund at any time.

Events, webinars, and conferences. Refund terms are stated at registration.

6. Course Access
We intend to provide lifetime access from the date of enrollment. We may update, revise, or retire Course content at any time. If we discontinue a Course entirely, we will give enrolled learners reasonable notice and an opportunity to download materials.

Course delivery depends on third-party platforms and tools. We are not responsible for interruptions caused by those providers.

7. Intellectual Property
All Course content, including videos, written lessons, graphics, frameworks, templates, and downloads, is owned by Fair Path or used with permission, and is protected by copyright. The FEAR NOT Framework, the Brilliant Jerk Formula, and the Anti-Workplace Bully Blueprint are proprietary to Fair Path.

What you may do. Use the materials for your own professional purposes. Adapt our templates, including sample policy language and letter formats, for use within your own organization or your own situation.

What you may not do. Copy, distribute, publish, or resell Course content. Share your login or provide access to people who have not enrolled. Use the materials to build or deliver a competing training program. Use our content to train an artificial intelligence system. Remove attribution from materials that carry it.

Organizations that want to train multiple people should contact us about group licensing.

8. Your Submissions
You retain ownership of anything you submit through a Course. By submitting it, you grant us a limited license to store and review it for the purpose of providing feedback and operating the Course.

Assignment submissions are optional in scope. You decide what you share, and your progress does not depend on disclosing anything you are not comfortable putting in writing. What you share is handled as described in our Privacy Policy, including our commitment that it is never used in public-facing content without your separate written permission.

Do not submit information you are contractually or legally prohibited from disclosing, including material covered by a non-disclosure agreement, a settlement agreement, or a protective order. Do not submit another person's confidential personal information, medical records, or your employer's privileged or trade secret material. You are responsible for what you choose to share.

9. Acceptable Use
You agree not to use the site or Courses to harass, defame, or threaten anyone, to violate any law, to interfere with the operation of the site, or to gain unauthorized access to any system. We may suspend or terminate access for conduct that violates these terms, without refund.

10. Third-Party Tools and Links
Our Courses reference and link to external tools, databases, agencies, and resources, and may include practice or simulation tools operated by third parties. We do not control those services, and we are not responsible for their content, availability, accuracy, or privacy practices. Your use of them is governed by their own terms.

11. Continuing Education Credit
Where a Course is approved for recertification or continuing education credit, credit is awarded subject to the requirements of the credentialing body. We report completion information as described in our Privacy Policy. We do not control those bodies' decisions and cannot guarantee that credit will be accepted or maintained.

12. Disclaimer of Warranties
The site and Courses are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.

13. Limitation of Liability
To the fullest extent permitted by law, Fair Path and its officers, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost wages, lost employment, or loss of data, arising out of or related to your use of the site or Courses.

Our total liability for any claim relating to a Course will not exceed the amount you paid for that Course.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnification
You agree to indemnify and hold Fair Path harmless from claims, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Courses, your violation of these terms, or your violation of any law or the rights of a third party.

15. Governing Law and Disputes
These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

Informal resolution first. Before starting arbitration or filing a claim, you agree to send us a written description of the dispute at [email protected] and give us 30 days to try to resolve it informally.

Binding individual arbitration. If the dispute is not resolved within 30 days, you and Fair Path agree to resolve it by final and binding arbitration instead of in court, except as stated below. The arbitration will be administered by AAA  under its rules for consumer disputes in effect at the time, and will take place in Richmond, Virginia, unless the arbitrator permits it to be conducted by video or written submission. Filing and arbitrator fees will be allocated as provided by those rules. The arbitrator may award the same individual relief a court could, and judgment on the award may be entered in any court with jurisdiction.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies. Either party may ask a court for an injunction to stop misuse of intellectual property or unauthorized access to a Course. Any court proceeding permitted by these terms will be brought exclusively in the state or federal courts located in Richmond, Virginia, and you consent to their jurisdiction.

No class actions. To the fullest extent permitted by law, you and Fair Path each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative action. The arbitrator may not combine claims of more than one person. If this waiver is found unenforceable as to a claim, that claim will proceed in court in Richmond, Virginia, and not in arbitration.

Opt out. You may opt out of arbitration by emailing [email protected] within [30] days of enrolling and stating that you opt out. If you opt out, disputes will be resolved in the courts described above, and the informal resolution step and the class action waiver still apply.

16. Changes to These Terms
We may update these terms. When we do, we will revise the date above. Material changes will be communicated to enrolled learners by email. Continued use after changes take effect constitutes acceptance.
